Drug possession with the intent to distribute or sell, even with a prescription?

Drug possession with the intent to distribute or sell, even with a prescription?

Postby croslea » Thu Nov 24, 2011 4:57 pm

So I just found out someone I know is a secret pill hoarder, so to speak. They get prescription painkillers prescribed to them for pain, but he either doesn't take them all and refills them or just continues to refill them or something. I don't know. But my question is.. He has A LOT of pills saved up, easily enough to just look like he sells drugs. Can he get caught and charged with drug possession with the intent to distribute or sell even if he has a prescription for all of them? I'm just thinking with the sheer mass of pills he has even with a prescription the cops or court would immediately think he's a dealer.
So what are the laws for this? I live in Texas if that helps, and please if you can have a link to a website or something in your answer that'd be great!
Thanks

If they are legally prescribed then there is not a law being broken. He can have as many as he wants up to the total amount of the total prescriptions. Once he goes out and gets caught actually selling them if he does then he has a problem. Until then no laws are being broken. It may look very suspicious but until he barters one or more of those pills unlawfully there isn't squat the police can or even will do about it.

I kind of see where your going with this but you are kind of reaching. This is like saying I know a guy who owns a legally registered and insured vehicle and his license is current and valid. But, he gets drunk as a skunk every night. Since he gets drunk every night there is a possibility he will drive his legally registered car, can the police do something just in case he does one time decide to drive his car when he is drunk? No. on both counts.
