Employer withholding last paycheck?

Postby eadweald71 » Mon Apr 04, 2011 8:10 am

I am from Long Island NY. While I know that labor laws differ from place to place. I would like to know how it works in New York State (Nassau County).

Does your ex-employer have the right to hold your last paycheck?

Even thou I did quit in short notice...

1.I returned any company property (shirt, store keys, etc) to them.
2.It was not part of any training for I have been with them for 2 years.
3.I did not at anytime get any form of "advance" pay so I don't owe them anything $.

I was told by my ex-crew members that they are not allowed to give me my check until I spoke to the boss personally:

1. My boss have not returned my phone calls
2. My boss have not answered my text msg.
3. I have to go through a 3rd person just to have a "meeting" set up to set up a meeting with them.

Is this LEGAL?

If I don't get my check who do I speak to?

Thanks for your help.

Contact the labor board or the employment security commission.

You worked, he owes you.
