Failure To Obey Traffic Device, Pulled Over After Parking

Postby Hasani » Sat May 17, 2014 2:23 pm

On Friday I went through a a light in town here in West Virginia, right before my car crossed the white line (about 5 maybe 10ft) the light turned yellow. I was not speeding, did not speed up to get through light. I go 2 blocks was going to parallel park in one place, got ready had pulled up looked behind me & seen no traffic, as I turned back forward I seen another spot that was closer to the building so I proceed up about 5 or 6 cars & parallel parked. AFTER I parked as I went to turn off my car a cop came up behind me & said I was being pulled over b/c I ran a red light...which I did not & gave me a ticket for faulue to obey traffic device I am wondering how I should go about this, as I have NEVER had a ticket ever for anything & I am in my 30's. Let me say this the cop was not only very rude & yanked my license & info from my hands (pulling my thumb in the process) but he called BACK UP!?!? I had my brother and my 3 children in the car with me and not only was this embarrassing, but the cop was so rude it makes me sick! My brother & I got to talking about it after his appointment & there was NO WAY I could have ran a red light, and there was absolutely nobody behind me until we went to get out of the car....the cop was not a city cop, it was a university cop who works with the city, but the dept, had been known to abuse the rules. So my questions is, how do I go about contesting this? Do I go to the Unv. "police dept" then University student affairs then the city or what? Any suggestions would be GREATLY appreciated! Thanks in Advance!

In California, running a stop light means the front of your vehicle entering the intersection when the signal light was red. Entering an intersection on a yellow light means not running a red light, even if the light turns red while you are in the intersection.

Look up the particular code section in West Virginia, and read exactly what it says.

Assuming it is similar, go to court to fight the ticket. Hopefully, the officer will claim the light turned red while you were in the intersection. That would obviously mean that you entered the intersection while the light was yellow, and as a matter of law you should be found innocent.

Does the quotation you had been provided have any directions on the best way to match it?
While he passed me the solution he explained I had a need to contact the amount about the base that will be towards the state magistrate. From my knowledge the particular inability to follow traffic indication he reported is not that much it's the costs for magistrate judge that we am unsure if I'd need to spend when they ignored it.
Like I mentioned I am truly annoyed, never experienced difficulty before and this previous month simply sucks.had my wallet taken, charge card applied (-450$) and today this and I'm a stayathome/pupil and husband is not obtaining much pay within the auto-body business...and we truly can not afford this. Want to attempt & understand this looked after and steer clear of courtroom when possible
