My ex is wanting to Terminate his parental rights and sign them over to my fiance soon to be husband so that he can adopt my 2 girls. My ex cant provide for them and has no time in his life for them so he wants whats best for them. I guess what I am asking is if both parents agree can my fiance adopt my girls or will the court make things hard? we want to get this done as soon as possible ..

You maybe should wait until you are actually married first and have been married for awhile before I would pursue something so permanant.

there is no such thing as signing over ones rights to another. Once you are married he could agree to terminate his parental rights so your new husband could adopt them. Boyfriends cannot adopt. It's a matter of stabilitly. If not willing to marry then how can be trusted to adopt. Still need an adoption homestudy as all adoptions require them.

Hi, After you're married, call your county Social Services and ask if they process home studies for a step parent adoption. Many states offer this service at a reduced rate. Usually a step parent home study is less invasive than a normal one, but it will include items such as background checks and meeting with a case worker. The home study process could take several months.

If your state does not offer this service, you will need to hire an adoption agency or family attorney to process this for you. Once the home study is approved and the children's father has signed papers relinquishing his rights, you will be ready to have documents drawn up to petition the courts for the adoption. This is more likely to go through court if you are married and can show stability.
