Father passed with detailed will an no benefidiaries listed. my bilogical full brother and i were to.........

we were to be left significantly more than half brothers whom my father had adopted...for whatever reason(in michigan) no beneficiaries were listed on retirement and on the life insurance policies and i am not sure who is at fault between hum, the companies, or his attorney who drew up the will. ofcourse the companies are paying it out inquartesrs and disregarding the will which i understand that is the policies. the executor knows this was not my father's wishes and can potentially testify to that. my half brothers are saying" oh to bad he f'd up and did not list anyone" and are being very rude and insensitive to the whole matter and do not see any moral dillemma. my full brother and I are disgusted and more so with the principle than the money if you believe it or not. do we have either a case of malpractice vs the attorney in michigan or can we get the money paid out properly in the court??? please give me feedback and allow me to discuss this with you b4 i spend $ on help.

I agree with folks here. Your father should have listed his wishes specifically. If you went to court, it would be a he said/he said situation.

That being said, if it's a substantial amount of money it might be worth your while to speak with an estate attorney.

I agree with folks here. Your father should have listed his wishes specifically. If you went to court, it would be a he said/he said situation.

That being said, if it's a substantial amount of money it might be worth your while to speak with an estate attorney.

I went through something similar. It was your Dad that screwed it up. In the eyes of the law, adopted children in the U.S. have the same rights as blood children. Only in other countries were full blood counts more than legal court crap do the true heirs to the estate gain.

Sorry for your loss and that your half brothers are so insensitive.
I suggest that you look for free legal advice first. There is usually a beneficiary listed on most life insurance policies.
Why sue the lawyer? What you need to do is settle this amicable with your half brothers.

In most states you are entitled to talk to a lawyer for free for 30 minutes. Check with the Barr Association and they should have a list in your area.
