Florida consumer rights - Hotel / Extended stay property - failure to maintain pool?

I stayed 11 weeks in Florida at a short term rental property with a pool. The pool turned green and was unusable for 25 days. Greater diligence would have corrected it sooner. Our August vacation was a bit spoiled, since we opted for the $1000 a week rental house BECAUSE of the pool. I'm unsure if standard landlord 15 cure periods to rectify the problem apply. Since the company operates under a Hotel license - I believe 'hotel law' is the applicable law.

AM I ENTITLED TO A REFUND FOR THE FAILURE TO MAINTAIN THE POOL~?? I BELIEVE THAT I WOULD BE UNDER LANDLORD LAW. THE 'LANDLORD/MANAGERS' WERE PUT ON NOTICE IN WRITING.

There defense then could be that we could have simply gone elsewhere, but that isn't so easily done on short notice and with a large family. We also were giving them reasonable time to fix, and it's 20/20 hindsight to say we should have left in the past, when we had no way of predicting it would take too long to rectify the problem.

In California, I believe it would be Consumer Affairs/Relations that you would contact, They are usually located in the government pages of the phone book. You can write them, send them copies of your receipts/pictures, and with all the elements of your argument. It will put your claim into arbitration, were they will investigate and call you with any further questions. If they do not have jurisdiction over that type of claim, they can refer you to who does.

and or: Call a local United Way, and ask them. Thats their job. To refer people to the proper advocacy's of assistance.

Best of Luck!!
