In the state of Florida do you have to have house insurance on a rental property?

Postby josephus » Wed Oct 26, 2011 5:36 pm

My wife fell and broke her ankle in 3 places while on vacation at a rental house due to poor maintenance, I called the gentleman and he advised me he didnt have insurance because he couldnt afford hurricane coverage. I was wondering is there a law about having insurance or is this legal. I tryed looking it up on google but cant find anything, before I even think about legal action I want to make sure he did not have to have insurance.

You sue him either way. If he has insurance, the insurance company may choose to settle without a lawsuit, just as he can choose to do. If he has insurance, the insurance pays the settlement or the judgement. If he doesn't have insurance, he pays the settlement or judgement.

No law. You can try suing him, you will have to prove he is at fault.

Probably not by law no. Just sue him. Now YOU will have a vacation house :)
