Rented a house with a pool. The pool is no longer usable and landlord refuses to count it in the lease. Help!?

Postby newyddilyn60 » Fri Jul 13, 2012 7:01 am

I am renting a house, doing a house-share and the property includes a pool. It is included in the lease that if the pool is used the way it's to be paid for as far as chemicals and what-not. We had the pool opened, spent money and NUMEROUS hours trying to get it usable. (We were lied to about how long it had been (incorrectly) closed). We used it for two days since it's been opened, and the ladders were installed wrong or something and the feet ended up going thru the liner (that was also not installed/fixed/stretched correctly). After asking what the landlord was going to do to either fix the pool or change the rent to reimburse for not being able to use the pool, we are being told that the pool was never part of the lease and we werent being charged for using it so therefore it's of no consequence we can no longer use it and if we do not pay full rent will be put in the process of eviction or held liable for full rent. What are my options?

Check your actual written lease. Even if it was implied that the pool was part of the lease, unless it's specifically mentioned in your signed agreement then you've got nothing to go on. The signed agreement is all that is important as it lays out what you're paying per month and what you're actually paying for.

suck it up.

do check your local tenant laws and free legal aid
in area. Do not expect much from either.

do get ready when lease up to move.

as for houses 1yr leases are hassle.

Your saved emails mean NOTHING. Emails are not considered as any part of your legal agreement to rent the premises. ONLY your lease contract is legal evidence. Thus, if your lease contract does not address the use of the pool, the management is under no obligation to provide a functioning pool which meets your desires.
