FMLA in Indiana; Can you take it for an In-law that lives with you and you take care of?

Postby rickie » Wed Dec 14, 2011 11:36 am

My grandmother was just diagnosed with dementia and sundowners syndrome (which these are both early signs of Alzheimer's) The doctor has ordered her under 24 hour care. We refuse to put her in a nursing home right now because she is still there; it's still my grandmother. My family has decided that she will live with all of us for a few months and then go visit the other brothers on kinda of like a rotating vacation house. My mother is wanting to take FMLA while she is here at her house; but this is her mother-in-law. Now my grandmothers place of residence is going to be my mother and fathers house; they are going to be her main care givers; we are trying to find out if because she is living with them and they will be her caregivers can my mother take FMLA for her? Can anyone Please help with my question? Or maybe point me in the right direction to find this information out? Thank you so much!

The protection applies to the "parent" of the caregiver. I do not believe it extends to relations through marriage beyond spouse and stepchildren.

There are multiple ways to get around it. If your Father is there, then your mother can submit an FMLA packet to take care of your father due to his mental problems created by caring for his mother. In other words, Grandma is sick, it makes your father depressed, and she has to care for him while he's depressed x number of times a week.

If your Father isn't around, it can be you that gets depressed and she can need the time off to care for you x number of times a week that just happen to coincide with your Grandmother's needs.

The form your mom will use is called a WH-380, download and print it from the net. Once a doctor signs it, where ever she works more or less has to accept it and grant her the protection.
