Gamestop policy violating Consumer Protection Act?

Like an idiot I purchased a refurbished Xbox 360 with 1 year warranty from Gamestop about 2 and a half weeks ago. The Xbox disc tray no longer opens and the system froze up several times over the past couple weeks.

I know that their store policy for used consoles is: full refund after 7 days, 30 days full replacement.

In the US, the consumer protection act states that within 6 months of the delivery or sale of a product to a consumer(me), that the consumer may return the product to the company without penalty and at the company's risk and expense.

And when this happens the consumer has the choice to have the product repaired or replaced, or a full refund.

Does this not apply here?

I know there are other factors but its just too much information. Gamestop policy is not law. Seems like they get a way with a lot because people don't know their rights.

It does not apply to refurbished goods. When you made your purchase you agreed to their policy.

The Consumer Protection Act doesnt apply to used or refurbished items.

In this case you bought a USED Xbox 360. You know when the return policy is and you failed to return it within the time indicated.

Once you bought the item, you agree to their store policy.

When purchasing the refurbished Xbox 360 from Gamestop, you agreed to their policy.

However, I'm not sure the Consumer Protection Act covers used/refurbished items. If I understand it right, it only covers new items, which is why it's covered under a 1 year warranty by Microsoft to comply with the law.
