Guardianship Of My Child

My dilemma demands guardianship in their State of: Mo. I've a two-year old youngster. Her dad lives is Mississippi. I actually do NOT require her to pay a visit to him, if anything had been to take place in my experience. How or what do I have to do to keep away from that from occurring?

Her father is on the birth certificate. Does he have the right to say "no, you cannot adopt my daughter"? If my boyfriend does decide to adopt, what are the required methods?

Get married and have your spouse adopt.<br />
Normally, Father is first in-line to obtain custody until there's a problem of unfitness (that you have not suggested).<br />
You MAY MAKE a will and contain "life guardianship", but this really is NOT legally-binding and the judge isn't required to respect your desires. Father might be first in line.

Your boyfriend cannot adopt.

Your HUSBAND can.
After you've been married for a year or so.
And yes, Dad has every right to contest the adoption.


If you decide to go that route you'll need an attorney.

Your newborn would likely become a ward of the State.
Then his sister can go to court and file for custody.
Both sets of grandparents can do the same thing...

Yes, that's why I mentioned "standby guardianship".
But the court - again - isn't legally obliged to honor your wishes.

We have a newborn. If something was to happen to both of us, who would our daughter end up with? He wants her to go to his sister.
