Has anyone ever sued their abortion doctor?

Postby dasco » Sun Apr 15, 2012 1:46 am

I don't mean for malpractice if something goes wrong or a HIPAA violation. I'm sure that's probably happened. But there are a lot of stupid lawsuits where someone makes a choice or a mistake and then sues someone else because they don't feel they should be responsible for the consequences. So, I'm just wondering if anyone has ever regretted having an abortion and then sued the doctor who performed it?

you cannot successfully win a lawsuit because of regret. the doctor constantly asks you (so ive heard) numerous times if this is what you want (the abortion) if you agree to it, that is your choice. you cannot then in return sue them because of regret. there are contracts you sign for this purpose.

HIPAA violations are a different issue, and im sure that any doctor that violates HIPAA has been sued. abortion doctors are not exempt to this.

People may have tried, but no such lawsuit would get anywhere. It would simply be a waste of everyone's time, since the woman would have no cause for action.

I can't imagine an attorney taking the case, certainly not on a contingency basis. So someone doing the suit would have to be rich.

There is also no basis, that I can think of, in law for such a suit. There are no grounds for it.

There are not as many stupid lawsuits as people like to believe.

Not happening. You FREELY sign a consent form BEFORE the procedure is carried out. No one forces you to have an abortion, the choice is yours and yours alone. Changing your mind later is not a legal defense.

I know a number of Doctors who do abortions. All of them, every single one of them, will REFUSE to do the abortion if they sense the slightest bit of hesitation in their patient. Regardless of the signature on the consent form.

I doubt it, you have to sign a lot of papers, and you're asked 3 times if you're ready. Once at councelling, once after your ultrasound, and then right before they begin the procedure.

I don't know the actually statistics, but I know abortions have one of the lowest rates of complications out of any medical procedure.
