Have you EVER heard of a case like this before?

Postby sebastiano53 » Tue Jan 10, 2012 8:17 am

I was called 2 months ago by an officer. I confirmed it was a real officer. He called my cell phone, which could only have been provided by the complainant, because my mom pays my cell phone bill from another state and I don't have a land line so there's nothing really official linking me to the phone number... He said an acquaintance of mine filled out a complaint about me and asked if I knew the complainant. I said I hadn't SEEN him in a really long time and haven't spoken to him in a pretty long time...the officer wasn't happy with my vagueness, although I wasn't lying. He assured me he had proof and wanted me to comment further. I declined to comment without a lawyer. He seemed quite irritated and said "I could charge each event individually, but I mean... you're gonna be charged with something..and I want this to be easy...so let me know what you want to do." I replied, "you tell me..Im not sure how this works, do you want my lawyer to call you?" He seemed unsure himself of how this would work...he seemed a little confused or thrown off and he said, "yeah you can have your lawyer call me, or I'll see what I'm gonna do here..."

My lawyer called him and offered to surrender me to the station the following business day, which was Monday (yes the cop called on Sat. Oct. 29.) At first, the cop told my lawyer he's about to go on vacation and doesnt want to arrest me beforehand. When the cop returned from vacation, my lawyer called again at which point the cop said he needs to get the complainant's signature and IF it happens it'll be another two weeks at least, maybe longer.... That was 7 weeks ago and 9 weeks total since initial contact from the cop.

What does this sound like to you? So many questions. Why did he call me instead of visiting me in person? Why did he call me so far in advance of arrest? Why did he decline my lawyer's offer to surrender me? Why hasn't he been forthcoming in calling my lawyer back (every single contact was initiated by my lawyer to the cop and once the cop even tried to avoid talking to him bc he was busy, but my lawyer persisted by saying it wouldn't take long...), why would the cops pursue an investigation when the complainant isn't even sure he wants to press charges? Why weren't my computer or phone seized? The complaint was actually first filled out on Jan. 3, 2011 and I wasn't called for almost 11 months... the complainant followed up on it and urged action to be taken...

It sounds like you are not guilty & someone (corrupt cop/faker) wants you to incriminate yourself.
Actually, you are not guilty, by law, as the onus is on them.

Tell them all to go back to their mamas.

Clam up & never give in to the corrupt legal system of the Americas!

I always fight the law & win.

Like Nick I also liked your story, but not as much as the first or second time (that I have read) that you posted it.

I like the story, very entertaining, it was either a scam to get personal info( hence the reluctance to talk to your lawer and lack of investigation) or a crappy cop.

Why, YES, I have heard of a case like this before. In fact, I have heard of several cases like this before. And they all have the exact same details to them, except it happened to different people, because we all know that one person cannot have multiple accounts on Y!A since it is against their TOS.

Seriously? How many times are you going to post this? How many different names are you going to use for this?

Kennedyclaire, clairemont, you can report me now, etc. Get a life, we don't care. Do you get off or something by posting this? Do you think you are bragging or impressing people? No one cares about your legal issues or problems.

If your story is true then deal with your lawyer.

That sounds like some kind of scam to me.The complainant must be a friend of the cop's and asked him to call you to try and scare you into something because an officer would have come to your door with papers showing the complaint.Plus you would have been read your rights about having a lawyer present. And since the cop hasn't followed any proper procedures he knows that calling you is wrong and could get in trouble.I would show up with your lawyer to the police station the cop works at and ask to speak to his superior and tell him what he's done and find out what this is all about.

Sorry not enough details we need to know about the complainant, you just say that you told the officer "hadn't SEEN him in a really long time and haven't spoken to him in a pretty long time". This could be a long lost friend or a family member. Think back, what you could have done to this person for him to take the matter to the law enforcement. The matter could range from stealing to murder. As the details about the officer it does seem pretty fishy. It sounds as if the cop really isn't a cop. Could be someone trying to scare you or something. Unless you get a official notice from a police department I wouldn't take this too serious. Ask your lawyer to look more into this "officer" call the phone number back from a different phone and try finding out who he really is.

I suggest you tell us what you are accused of because that matters. yes i have heard of this before, the case is low on the priority list and will take years if no action is taken. Next, you should tell the lawyer to tell the officer that you feel you are emotionally distressed by the lack of movement in the case and if nothing starts to move that you will sue the complainant. You have legal rights too and the complainant has to make a choice to drop the charges or to press them.
