Hello I'd This Terrible Partner Who's Suing Me For Breaking The Lease And Moving Out.

Ok lengthy story quick. I moved in with a buddy I did not know to correctly for about annually with no agreement. And so I basically only satyed in my personal space im a basic going person. In July he'd to renew his lease and pointed out my name had to be onto it, but I can leave if I gave him notice. Well I could not stand him a minute longer. He was dirty, harased me constantly, and loud although I was resting only so he can request a drive and wake me up and in fact broke the lock on my door. I moved out finish-of March and also discomfort for Nov. He was not pleased in any way. I agreed to find him a partner but he declined. I did not feel safe or comfy there whatsoever. I did not notice for him for 7 months till I received a subpoena in the mail saying he was taking me to tiny-claims for breaking the lease. I spoke to the landlord about this and he knew absolutely nothing about it. This individual is such a dirtbag, but I probly may well have presented him one more months rent considering that I was so pleased to eliminate him if he asked for it. Does he have an incident

Not genuinely since.... You paid for November rent, moved out.  This guy had ample time to replace you, find yet another roomie considering that he turned down your offer you of finding a replacement.  Beneath standard circumstances, they would hold you accountable for rent for the dureation of the lease if you just left, but he triggered your departure.  If he's still living there after you left and the landlord has no troubles, he has no business suing you.  You didn't leave him with any burden he couldn't handle.  jm0405 42 months ago Please sign in to give a compliment. If you were on the lease, yes he has a case. If he admits that you had an oral contract allowing you to move out at will then maybe you have a defense, but, since he is taking you to small claims court he appears to not remember that. Did you get anything in writing from him?

If so, you put yourself on the hook for the lease for as long as the lease went. If not, not. And if not, one wonders why he's going thru the expense of a lawsuit. Then again, if he's that desperate, it would explain his previous behavior with you.

If you notified the landlord that you were moving and remove you from the lease then you're okay. If you just up and moved without getting removed from the lease then you may have a problem. The good news is small claims court is a joke. All small claims court is about is a private citizen buying a judges time. They can't force you to pay anything, put you in jail or garnish your wages(but it can affect your credit if you don't pay) Don't skip out on it though, plead your case to the judge, try to recruit the landlord to your cause by asking him for a written statement in your favor if possible.

He has a case in only one way: if you actually had your name on the lease and had signed that. If so, you put yourself on the hook for the lease for as long as the lease went. If not, not.
