How can I ask for a payment plan for a speeding ticket? (NYC)?

Hey.

As the court date for my speeding ticket draws near i realize i may be facing a hefty fine of up to 300+ dollars. Do i have to ask the judge right away for the payment plan option or would i have to talk to the clerk?

Also the ticket i was issued said i was doing 82 in a 50mph zone. When i drove back to the highway the speed limit reads 40mph, would it be bad to bring this up in court as well?

You may ask the judge. I dont think it would hurt.
Dont bring up that it was a 40mph zone. The officer the stopped you was probably giving you a break

I don't know if the officer thought the limit was 50 or if he made a clumsy attempt to cut you a little slack( BTW, officers do that quite often) Usually, the ticket is written for a bit less that the actual, to allow for a lesser fine. Combine that with a 'cushion' of 5 MPH to allow for speedometer inaccuracies, and it is pretty nice of the officer. The court will ask if you would have trouble coming up with this amount all at once and ask if you would like a payment plan. This is pretty standard

You are lucky you are not in jail with a reckless driving ticket

The court may grant you a payment plan but with your speed over the limit he may also suspend your license as you are dangerous on the road

And your insurance company will not be happy with that amount of speed over the limit wither and they may cancel you as well
