How can I defend Frankenstein against the charge of malpractice and negligence?

My class is having a mock trial, and I am an "attorney." The case question is, "Was Dr. Frankenstein guilty of malpractice and medical negligence?" I am wondering if anybody knows a couple of good reasons to defend Frankenstein against this charge. Also, if anyone knows any good questions to ask any of the characters, please let me know! Thank you in advance!

As his subjects were already quite DEAD, I'd find it difficult to find the good doctor of either charge in relation to them. Though some villagers also died, that was not due to malpractice in any way. Now, as the doctor did permit the monster to get out of his control, one could possibly make a case for negligence on his part in the deaths of any villagers. Even then, you'd have to prove that the doctor had prior knowledge of the monster's inclination to kill; and I'm not sure that that case could be successfully made.

Check out 'wrongful life' lawsuits.

You'd also have to find laws that argue against disrupting buried bodies. I am sure that they have them in England, as grave robbing was illegal. Argue about how the owners of those body parts did not sign off on their being used in medical experimentation.
