How can I reclaim a domain name stolen through my search history?

Postby hackett » Tue Jul 31, 2012 6:31 am

So I'm sitting at work when the most unique idea comes to me. I wrote down six possible domain names for this idea and found them all available via both Google and GoDaddy searches. I tossed the idea around for 2-4 days then proceeded to GoDaddy to buy the six in the event I went forward with my idea. I found 2 of the 6 names taken. These domain names are so long and unusual there is absolutely no way anyone would have conceived them. I quickly snatched up the available four and the .org, .mobi, .co, etc. on the stolen two. I contacted the purchaser to see if he would sell them to me but got no response. I waited a year to see if the purchaser would renew the domains and he did for another year. I contacted him again and he offered to sell the domains to me for $75,000. These domains are parked and the purchasers appears to have no need of them but to sell back domain names obtained through stolen search histories.

My question is -- can I trademark, copyright, patent etc my domain name(s) to reclaim them back?

1. They were never yours before he/she bought them.
2. You either pay for them or not.
3. They were not stolen, they were bought quite legally, you have no recourse in law?
