How do I file a complaint against an animal Control Officer for discrimination?

Everett Wa: An animal control officer took my dogs & cat, without even citing me, they euthanized one, & won't let me see them. I have had trouble with this woman for years but I figured it was just because she was a jerk, but I just got all my discovery for trial, & noticed something VERY disturbing: In all 3 of her reports she HAS to make a point of calling me a "Thin Native American Woman". What does that have to do with anything? I can understand in the warrant request, she would say it to describe me, but there was no reason to pit it in the incident report & the court report. So I put an ad on craigslist asking for others who had had trouble with animal control & got numerous responses from people, all but 1 were minorities. Part of me thinks this is ridiculous, but there is a part of me that is starting to face that maybe there really are people who still think like that left in this world... (?) I want to know how to proceed legally or if I can file a tort claim against the actual City of Everett, since they are a city agency. I have asked the other people to join me in a class action lawsuit but they still live in Everett & still have other dogs they can take & are too scared to even try. I moved specifically to a place that doesn't like them & has their own animal control. I also need to note: I run a rescue & rescued animals, namely bully breeds from there because they have BSL & every dog I pulled from there had injuries & some were maced as well. I complained about that & they quit letting me pull dogs from there so I sent some of the big guys in Pit Bull rescue in there to go pull them anyway which is what I "thought" this was about. I know this has about 3 different facets but I need to know how to proceed.

You aren't ready for the discrimination suit yet. Not even close. Your craigslist experiment is interesting but would be ripped to shreds in court.

Discrimination suits are difficult to win, because discrimination is the easiest thing in the world to claim, but the hardest to prove and the burden of proof is on you.

Here's how you'd need to proceed.

1) First of all, get your own house in order. Until you have your own dealings with the court taken care of, don't even start this.

2) You need to get all the records from the City of Everett regarding animal control and the racial makeup of the litigants. You'll need to issue an FOIA request for this information.

3) You need to compare this with both the percentage of minorities in the city, versus similar information for both the state of Washington and the country to show that the percentage of actions against minorities are significantly higher in Everett than the rest of the country. You can be sure that if you don't do this, the City of Everett will and use it against you in court.

4) You also need to take into account the number of defeated actions. If there is discrimination, a higher percentage of defeated actions (that is, actions where the defendant prevailed) will be higher for minorities than for others. Check for this.

All of this will take a lot of time and a lot of money. If you are prepared for that, then good luck to you.

She puts it in her incident report and court report so that they match up with the warrant request. I am guessing there is more to this than you are stating. File a complaint and move on. You have no basis for a lawsuit.
