Someone who does not own a registered trademark, but who is using the (R) symbol all over their web site, has filed a lawsuit against me for using the same mark (I don't put (R) on mine).

I'm told it is illegal to use (R) when the mark is not registered.

How do I report their illegal activity, and how do I ensure that they are suitably punished for deliberately breaking the law and interfering with my (prior) business?

Contact the Trademark registration office in your country.

In any event, their use of the Trademark symbol illegally has no real bearing on the result of your suit. If they can establish the use of the trademark before you (and the likelihood of confusion in the marketplace), they can win the suit.
