How long does the eviction process take in Michigan?

Postby hrafn » Sat Jun 16, 2012 1:05 pm

We received a seven day notice to quit last week and we truly just can't come up with our rent due to layoffs. We have tried to work out an arrangement with our rental office but they won't hear of it (It is in a nice area and they can get employed people in easily is probably their thought process, and I do understand). They will be filing a S&C for eviction shortly. We can have a place to go but not until August 1. How long will we be able to stall the eviction process? Are landlords more willing to set up payment arrangements after an eviction? Will they garnish our bank account immediately afterwards? Any help would be great!

Immediateley.

if its a mortgage it takes 3 months,

if your a lease-er / renter, its usually 2-3 months but they do have every legal right to start right away if they want to, even if its like 30 seconds late............

The eviction is a legal process that must be handled by the court. When you do not move out after 7 days you will receive a summons which will have a court date. You can appear at that court date and present your case, however if it is based around 'we have no place to go' it is a sure loss since that is not the landlords fault and the court will not make landlord pay for your problem.

An order of restoration (or whatever your county calls it) will be issued and a judgement issued in the landlords favor for the unpaid rent, any penalties, the court costs and any damages to that date

Once the court decision is made, the sherrif will post the house for eviction and appear on that date to physically escort the people out of the buiding.. (they do not move furniture.. )

Your landlord will then move in and rerent the place and either give you your furniture or store it if you are not there.

The landlord does not need to set up a payment process. the Court already has one for him

Once he has that all in order, he can take the court order to your employer who will with hold up to 50% of your check until the debt is settled. If there were damages or costs for the storage of your furniture the landlord will either sue you for that or appeal to the court to add it to the existing judgement.
