How many times can CPS ask me to submit to a drug test?

How many times can CPS ask me to submit to a drug test?
My niece has been in FOSTER CARE since October 2009. My brother does not acknowledge the child though paternity has been established via a court order (& I have a copy of the positive result). The child's mother is supposed to go through a series of classes, which she has yet to complete.
We reside in NYS and because the law allows for the relinquishment of PARENTAL RIGHTS if the child is out of its home 15 out of 24 months I have decided to seek custody of her... CPS was informed by 'someone' that I abuse prescription drugs... and so they when they came for a home visit on a Friday they more or less demanded (by saying it makes me look bad if I don't) I take a drug test. So I ask can I get a week...they say that if I wait that long it will look bad and then they give me some #s to call to get the test done (I work FT and am a FT parent though my job is flexible I am still in a probationary period).
As soon as they leave I'm on the phone and the tester's next available wasn't for another 10 days (2 mondays later).. I call the CPS worker and tell her... She calls me the following monday (3 days later) nd is saying well if your job is flexible you should be able to leave work early and take this drug test... She stated multiple times that HER supervisor suggest it... I explain I can't because I am already coming in late the next day due to CPS ordered visitations with my niece (on Tuesday 10a-11a)... blah blah the try to guilt me more...
So me being nice hound my boss for more time off the next day and she agrees... So I'm calling and calling all Monday afternoon and mot of Tuesday morning to see if I can be squeezed in the following morning after my visit.... 15 minutes into my visit they call and then say can I be in the office at 12noon sharp for the test but I have to come back in the original date to get the screening (questions about history, family, etc...). So I go for the test and pass it....
Now for the day of the original appointment The guy is 15 minutes late because he made the appointment at the wrong office... They take my insurance info but can't seem to find the forms I need to sign... So they ask the questions and then ask for another test... I do not do the test because I am at my heaviest point of my mmenstrual cycle (the man only gave me a half sized paper dixie cup no wet wipes no nothing)... The screener gets upset saying oh well I need to present my case blah blah blah... So I told him I can do it tomorrow after my visit with my niece... He asks whats the difference between now and tomorrow... I told him I'll use tampon INSTEAD of a pad... He looked at me and blinked...
My problem is I take the bus to get around and I know I will not get to work by the time I said would tomorrow because unlike last week I didn't get approval for additional time off....
So my question is HOW MANY TIMES? and WHAT IF i DON'T SHOW FOR IT ? I'm not the one on trial here my niece's parents are... At what point can I say enough is enough?

If you want to get custody of your niece you probably cannot ever say that enough is enough. You will have to do the tests when they want you to do them.
