How to get compensation?

Postby morcan » Wed Jun 27, 2012 1:01 am

A Government agency worker has breached my rights to protect my personal information. On a letter written, he exposed my Insurance Number, payment details, Name and address. The letter was intended to a non official person and therefore the information was given without justification.

Go to the Mighty Oak in the center of town and hug it tightly. Sing the "Friends" song from Barney the Purple Dinosaur. Your compensation will come raining out of the leaves of the tree come autumn.

If you are looking for compo, I suggest you go into Tesco and pretend you slipped on a wet patch, you will stand a better chance of getting something. I am not saying you will get anything at all but you will stand more of a chance than trying to get some from the person that wrote the letter. You have not told us why the letter was written and received.Sorry and all that.

Try suing DVLA first, they are selling our details to anyone who is prepared to pay for them. Name address DOB you name it they know it.
Suing is not free in the UK and you would need thousands of pounds and concrete legal evidence that you have a case.
Move on, you do not have a chance.

1) you dont have an automatic "right" for your personal information to be protected. It can be shared within all subsidiaries of a company that you gave it to, all government offices, or government agencies, or companies acting for govenrment offices or agencies. ALL that required is that they are only giving sufficient info to complete the task required of them.

2) just cos it was written to a "non official" person does not mean there was not a reason for writing it and giving that info.

3) your NI number, and address are not personal information. (its easy to find your address, and your NI number) - "payment details" is not specific - it may be personal, it may not be

4) the individual worker does not breach your rights. The company/agency/department may breach your rights by allowing the worker access to information not required by them in order to do their job, AND by allowing them to transmit that info to some other company/agency/department without the necessary authorisation.

Conclusion - you have no chance.

What do you mean, a 'non-official person'.
The milkman?

If you believe your data has been compromised by the wrong ul act of a branch of govt, your first port of call is the Information Commissioner.

If you're waiting for the compo to fund anything specially, I'd not rate your chances.
