How To Handle Job Termination And About Valid B1 Visa

Postby Bjorn » Sat May 31, 2014 4:10 am

Hi Umesh,

I'm from Pune, Maharashtra, India.

Here is the background ---

I carry now total 7 years of IT experience in Testing. 3 years in first company and 4 years in second company. Very recently I resigned from second company and joined third company, which terminated me just after 1.5 months of service. Reason given was that - I mis-used the laptop given to me by the company, when actually there was a serious virus which turned the laptop upside down with weird windows/ things that had started poping-up/ happening on my company laptop.

Here is the current status ---

I am now looking for new job. I do not want to spoil my 7 years of great career track and my future, due to this unfortunate incident that has occured. So while giving interviews I am saying that after leaving my second company, I went on to sabbatical leave for around 1.5/ 2 months, for some personal urgencies and now back looking for job.

I hold valid B1 visa(10 year, multiple entry) from this third company which terminated my job, after just 1.5 months of service. On this B1 visa, I had a short trip to US for business for 15 days.

Now, following are the questions going on in my mind. Need help:

1> I am not disclosing this 1.5 months of experience with third company which has terminated me. I'm saying I was on sabbatical leave, after leaving second company. And now back looking for new job. Is that ok?

2> What should I tell when I get into new company: I have B1 visa or I don't have B1 visa?(my B1 visa does not carry the name of the company that has now terminated me)

3> Even after job termination, is my B1 visa still valid?(the company which has terminated me has not put any cancellation stamp on my visa)

4> Can I travel to US using the same B1 visa from another company? Looking forward for your early response. Thanks in advance Umesh for all your help.

Regards,

Shilpa

How To Handle Job Termination And About Valid B1 Visa

Dear Shilpa,

Hope you had a great weekend. Sorry for your loss of recent job. I am answering your questions point-wise.

1. You may mention any reason instead of the actual fact which may hamper your reputation and subsequently career in various ways especially during reference checks with the previous Organisations etc.

2. As B1 visa was issued by second company; mention details about second company only. As whenever you opt for B1 they'll probably look out for information about previous employment.

I am not an expert in H1B or B1 Visa therefore unable to answer against your Q3. Q4.

But you can take help of immihelp.com, workpermit.com

Warm regards,
