I have been accused of keying a car. Just want to know what i should do.?

Postby wardell » Tue Nov 22, 2011 1:16 am

the cop that saw the video said they have me on camera walking by the car, but he said the footage does not show me actually physically scratching the car. the cameras were not in the right angles to see an act like that occur. do i have a chance on fighting it and do i have the right to see the video. they say they had somebody follow me out of the dealership and watch me and saw me do it, although i do not remember anybody following me. the cop said i should just pay the damages ($250) and not fight it cause they have a witness but i always thought if they dont have solid video evidence they dont have a chance. please help me and if you have experience in new york law that would be great thank you. p.s. i am also going to criminal court.

Sure pay a lawyer $1000 for a $250 settlement

Makes perfect sense to me

You did it, they have an eye witness

Pay them before you get a criminal record and it ruins your life

If you have to ask what you should do, then your not a very bright person

Did you really do it? Why? Well if the video camera is not clear, then there's a chance it won't hold up. Depending on the witness, are they credible? And witnesses can be very important to a case and if the witness identifies you doing it and they are credible, then you will probably lose. The cop probably told you this because $250 dollars is better than paying for attorney's, court fees, etc. If you did it just pay the person since you vandalized the car and if you didn't then why are they saying you did it. Revenge? Anger? etc.
