I Have Credit Card Debt In My Mothers Name

Mr Paisola,

Thank you for taking the time to read my question. To start with Im in NC. This began 8yrs ago when I left my husband and I was trying to get started out as a single parent of 1. My mother allowed me to use her credit in emergencies, etc. all mail came to directly to me so her husband wouldn't know. I would get 0% offers in her name so I would transfer the balance. Now Im up to 4 cc at a total of $25000. For 8 yrs I have made all payments on time until recently, I was out of work for surgery and now I am having an awful time getting back on my feet. The cc are late, min payments are outrageous and they are now calling my mother. She is married but no assets are in her name and she has a seperate checking account. She is retired and draws $300 a month SS.

When the creditors call her she tells them it is my debt and that I am working on it and that she refuses to press charges against me.

What steps should I take? Should my mother send a DV letter? Should I send a letter stateing my hardship and what I can pay each month until I get caught up and ask they contact me only?

Mom is not worried about her credit taking a hit, she and I are concerned at how far they can go with this.

The internet down here is difficult, so I am being patched through our NYC office to assist you! Here is the way that I see your issue. You were given permission by your mom to use the cards. She also gave you the ability to transfer the balances due to the fact that you were receiving the solicitations and she endorsed this.

The bottom line is that the accounts were opened 8 years ago, that limits the prosecution for fraud due to the Statute of Limitations.

So, here is what I would do.

First, I would try and call the creditors and ask them to reduce your interest based on hardship. Then agree on a lower payment amount that you can handle.
