lock property was sold in 2000. The new owner had it surveyed and the original owner granted him an easement across my property. When I purchased my property in 2002 the original owner changed the original easement and desinated a new easement and my survey shows the new easement. In 2009 the landlocked land sold for the 3rd time since 2000. All of the previous owners including the current DID NOT get new surveys. They all used the second owners survey. My survey shows the new easement and does not show the old one from 2000 survey. I am planning on using my land to put in storeage buildings and a garage. The latest owner of the landlocked land says i can not block the original easement. I feel he should have gotten a new/current survey and he would have been told/known of the new easement. What do you think my rights are?? thanks, MIKE

Your easement from 2002 will prevail. The other owners should have obtained new surveys and they cannot give you problems because they decided to save money and not get a new survey. They will find out that it was an expensive mistake.

I would go to the title company that issued your title insurance policy and have them research the easement before getting any further into your project just to make sure.

It sounds like you are OK, but an ounce of prevention is worth a pound of cure.
