Postby Oshay » Tue Jan 21, 2014 4:14 am

Couple weeks later, I got a mail that says "People of the State of California Vs. me" and something about minute order.Ex parte hearing re: officer not servedofficer not served due to medical reasonscount 1 dismissed in the interest of justice.cash bail exonerated.infraction hearing concluded, hearing dispoednotice mailed to defendant.**minute order of court proceeding**Is this mean that I won the court case or do I still have to go to the court to fight this(I have court date in couple of days)?

The state of California has decided not to go to trial in this matter since their most important witness(the police officer who ticketed you) can not attend due to medical reasons.  You got lucky.

You should call the courthouse to confirm, but yes, the letter means they've dropped the case. An ex-parte hearing is one in which the judge issues a verdict without the necessity of all parties involved being present. In this case, the judge issued a verdict of 'not guilty' without you or the officer having to go to court. It sounds like the officer in question is unavailable to appear in court, and rather than make a big deal out of it the judge just sided with you and gave your money back. So hooray for that!Hope that helps!

It means you won the case by default because the officer involved in serving you the ticket could not attend the hearing for medical reasons. So they also refunded your bail...However, it doesn't hurt for you to call the courthouse and verify this.

Well, you didn't really win, but the case was decided in your favor as a result that the officer was not able to be served.  So, you got your money back that you paid for the ticket.
