Since it was "verbal" it becomes a he said - she said issue, and there is no issue. If dental insurance was unwanted, it is the employee's responsibility to notify the HR department, in writing.  There would be no way to recover the amount, since it's been paid to the insurance company, and yes, it is most certanly the employee's responsibility to check their paycheck stub every payment.  I question, with the HR department, when my check is 25 cents different without a valid reason.   Schelli's Recommendations Confidential Compensation: Increase Your Employees Take Home Pay While You Reduce Your Expenses. Really, I do not believe that it has to be refunded.  Employees are responsible for their awareness of their paychecks and the deductions. (It really was a failure on the boss? part not to notify HR of course).    In my experience you have to sign waivers of insurance - any kind - if you are opting out.   It is a sticky situation but it is what it is.  I?d be sure all the paperwork process is firmly in place for the future.
