The worker informed the chef verbally 1.five years back he did not need dental insurance-but never ever delivered notice to Time. It occurs a lot... Truly, I do not believe that it has to be refunded.  Personnel are responsible for their awareness of their paychecks and the deductions. (It actually was a failure on the boss? part not to notify HR of course).    In my encounter you have to sign waivers of insurance - any kind - if you are opting out.   It is a sticky predicament but it is what it is.  I?d be certain all the paperwork procedure is firmly in place for the future. It appears like the "boss" erred in maintaining the employee on dental insurance. But, it was the employee?s duty to raise a red flag sooner with HR. At this point, I feel the business removes the employee from dental insurance coverage--assuming he still doesn?t want it--and the employee eats it.   Nonetheless, in the interest of employer-employee relations, I consider some verbal TLC is in order to attempt to smooth out any ruffled feathers. I don?t know what the total quantity of cash at situation is but, I doubt it is very a lot. If this is a leading worker, the company may want to cover the misunderstanding quietly. If not, it could be shared 50/50 but, it doesn?t require to be.   You must have HR verify this out for you, but the employee might be able to defray some of his dental expenses more than the past 1.5 years by filing retroactive claims. Please check first with the carrier to be confident they would accept a claim over a year old. You don?t want to raise expectations if it is not feasible.

This is an unfortunate situation It looks like the "boss" erred in keeping the employee on dental insurance. But, it was the employee?s responsibility to raise a red flag sooner with HR. His request should have been followed through on but that having been said I doubt the company is required to pay him back. I think he bears some responsibility since he waited 1.5 years; to wait that long makes no sense. Did he say why he waited so long before saying anything?

Since it was "verbal" it becomes a he said - she said issue, and there is no issue. If dental insurance was unwanted, it is the employee's responsibility to notify the HR department, in writing.  There would be no way to recover the amount, since it's been paid to the insurance company, and yes, it is most certanly the employee's responsibility to check their paycheck stub every payment.  I question, with the HR department, when my check is 25 cents different without a valid reason.   Schelli's Recommendations Confidential Compensation: Increase Your Employees Take Home Pay While You Reduce Your Expenses.
