I was held down and given a blood test my arms messed up can I sue?

Postby darce » Fri Dec 23, 2011 2:10 am

I was pulled over nothing was damaged and no one was hurt I was just driving. The cops arrested me and said they were going to give me a alcohol blood test so they took me in brought me back to the station. Ive had a fear of needles ever since I was young because of surgery. They told me I was going to get it done and I told them I wasn't ready and didn't like needles. They said were going to do it and then a bunch of them grabbed me strapped my head back and my arms held me down and stabbed me with a needle. They got my blood and then put me in jail. They wont get the results back for awhile but the fact is they held me down and now Im out of jail its been 5 days and my arm is all bruised up black and yellow and a little puffy looks swollen. Ive heard of doctors getting sued for malpractice for the smallest things even when saving someones life. I hear someone sued McDonald's for giving them coffee cause the person burnt there mouth and now they have to put caution its Hot on the lid now.. I also have had blood drawn before and its never looked this way so this was nonprofessional. Is there a way you can sue for this? I spoke with a couple lawyers but every ones either scared or no one covers that kind of lawsuit. I don't know who to get in touch with? They also when I was bonded out had my belongings in someone elses bag and gave me the wrong clothes. It took the Clark County Detention center an extra 20 Min's to find my clothes and they were in someone else s bag. So theirs proof everyone makes mistakes. I just don't know if there could be any long term or short term damage due to a possible nerve damage or busted vein. Ive heard of people renting houses and being exposed to asbestos and getting cancer 20yrs later that's a health matter so why wouldn't something like this be.... Should I go see a doctor and I don't really have the money to pay for this if I do go.. But Its better to be safe then sorry. Wouldn't that be malpractice though and you would be able to sue the cops for it??

I personally don`t think that you could-the police thought that you were possibly under the influence
they were just doing their jobs. I am not a judge or a lawyer so you would have to get a judge/lawyer to answer sorry I could not be of more assistance!!!

You could have caused the injury by moving...

Try asking these guys about it, they deal with malpractices and stuff like that. Even if you can't sue, at least you will get some sort of compensation I think.
