I was in a no fault accident. Insurance says go through WSIB. What are my rights?

Postby fyfe » Tue Dec 13, 2011 9:28 am

As for the details of my case, I am currently emplyed as a car jockey through a dealership. We do dealer trades with other dealerships. The company vehicle which i was driving back from the dealership was involved in a major fender bender in which the other driver was charged with careless driving. As a result of the accident, I suffered a whiplash type 2 according to reports by my family doctor. Anyways, long story short, I made the claim with my company insurance telling them truthfully everything that happened, they tell me to file an accident benefits claim with my own insurance company, which I did, and they said the cant approve me for accident benefits because it happened at work, in turn they say go through WSIB (workers compensation). Why is something that is not my fault, am I being treated so unfairly. Mind you, I am in pain and am getting through work day by day, bearing it hour by hour. I cant afford to miss work which I why I am working. I want to get better, yet cant get approved for physio. Please help, any1..

You have to take it from a business stand point. No one wants to pay for those injuries and be liable because that can be a very expensive claim to pay out. Especially if you are in pain. My recommendation would be to seek advice from a free accident lawyer, they come in bunches and would be willing to take a case like that ASAP.. They will get you everything you need want and more.. Relax and dont be stressed. You will be taken care of.
