If A Mother Signs Custody Over To The Father, If She Wants Custody Back Can She Get It?

My friend signed the custody of 4 of her children over to their father. She wants to get one child back because the child is treated unfairly. Can she do it?

Probably not. She is going to need a good lawyer, and a court hearing. I feel sorry for the three she doesn't want. That must hurt them, a lot. TurboB 26 months ago

Unfairly doesn't mean abuse necessarily. If you have 4 kids, one is bound to think the parent is choosing favorites.You would need to prove inadequate parenting or abuse in court. No doubt the father would fight her and the kids may also take his side if they feel they will be separated. Wanting just one child back? Sounds like the kid has you snowed. I think she should talk to the father and find out what's going on. MaryAnn 25 months ago

What TurboB said - the father has to want to give custody back, or the mother has to prove that the child's best interests are with the mother, which would be an uphill battle if she gave the custody up willingly.BTW, I'd love to hear what "... the child is treated unfairly" translates into.
