You can always sue. Whether nor not you would win the case depends on details you haven't provided. There are thousands of lawyers that specialize in medical malpractice lawsuits that would love to speak to you and won't charge you anything. They work on contingency for a percentage of what you get if they win the case for you.

No he gave advice in a personal setting not a professional setting. And you could have ignored his advice.
