If I paid for my credit report for an apartment rental, am I entitled to a copy?

Postby patwin87 » Mon Oct 31, 2011 5:20 pm

I am attempting to rent an apartment with my boyfriend and we are getting the run around at a company due to my old medical bills, and boyfriend being on the job 6 months (even though he's making 6 figures and the place is only 1600 and his credit is squeaky clean). We paid $50 for the reports, so aren't we entitled to a copy of the reports if they do not rent to us? Why would they get to keep it if they are not renting to us and WE paid for it? I know there used to be a law in California that if someone ran your credit, they had to give you a copy if you requested. Is that still implemented?

"If your credit application is turned down because of an error on your report, the lender is required to provide you with the name and address of the credit bureau that issued the report. Then, you have 30 days to request a free copy from the bureau. The bureaus must disclose to you all information in the report, its source, and who has recently received the report."

No, you are not entitled to a copy.

However, if you are denied credit, you are entitled to a free credit report from the credit bureau that the creditor used to deny you an apartment.
Beginning 1/1/2011, you are also entitled to know what the credit score was that prevented you from getting the apartment. The creditor only has to give you the score, he doesn't have to tell you which score. It is usually based on your FICO, but not necessarily.

Take care

First and foremost, you shouldn't be paying for a credit report. The law gives you a complimentary copy once a year for free. If you paid for it, demand that they give it to you. Once any company run your credit report they must provide you with a copy if they are denying you. Fight for your rights don't let these people that don't know how to run a business jerk you around. Thank God you are not doing business with them because I can see signs and symbols that you would have problems with them.

Why don't you and your boyfriend consider buying a home. If your credit is tarnish you can still buy. Don't rent, you will be wasting your money. The house doesn't have to be your dream home because you can always rent it out or sell and buy the one that you like later. It is so much smarter to own a home than to rent. Only rent if you really cannot afford to buy a home. There are greater tax benefit for homeowners. Not renters!

An argument would be, we are not married; you don't have to be. Create a written contract of what you expect each other to do with the house and get it notarized. It would be a legal and binding document.

Good Luck!
