What happens if i have a eviction on my record even after i paid and continued to live in the apartment?

Postby hanan » Sat Mar 31, 2012 10:02 am

I just found out that i have an eviction on my record, after a dispute with a apartment complex who i worked for (who paid me in rent only). When i quit the job they charged me that months prorated amount for rent plus the upcoming months rent amount, along with $25 per day i didn't come up with the amount. They served me an eviction notice and started an eviction process, i paid all fees owed, but they apparently never stopped the eviction process. Not only did i continue to live there, i also started back working there. Now i find out 6 years later i have an eviction on my records from this apartment complex, what can i do to fight this?

After 6 years time, it may be a little hard. Try getting a letter from the management of the apartment complex stating that the rent and fees had been paid and that the eviction was never finalized. Then take that information and add a letter explaining the basic situation and send it any company that is holding those "records". (I am guessing the "records" you are referring to would be credit reports). Be sure to keep copies for yourself.

If doing this doesn't clean up your record, then you may need to check with a lawyer to help you file the right forms with the right people to get it cleared. You could also ask how much longer it will be on your record anyway. Many things drop off after 7 to 10 years, so if this is the sort of thing that may just vanish in another year, it may not be worth the headache of changing it.

As far as what could happen, if you try to get a loan for a home, you might be denied. If you try to get loans for other things, you may have been paying slightly higher interest rates than if that information had not been there.

Go to landlord and Tenant Court in your city. Get the actual documents from the court. They will tell you the truth. It wasn't removed by that court when you didn't get evicted. It may take some of your own time to gt this corrected. But if all of your ducks are in a row and the documentation is there to prove it should be off and should have never been added. It will be removed.
