If I quit my job because of an injury can I still get workers compensation?

Postby eoforwic » Fri Apr 01, 2011 10:10 pm

I had a back injury where I work and the Doctor told me to get a different job.I told the employer that I was getting done cause of the injury and what the Doctor said.
He didn't answer at the time.
So I went and got a different Job doing light duty. Two days later the employer calls and said he could put me on light duty.
Should I stay with the old employer and do light duty where there are no set hours,I may only work 10 hours a week..
OR should I take the new Job with set hours and more pay per hour.
If I take the new job can I still get workers compensation from the old employer or even a comp settlement.?

Tell your old job you would like to go back but the hours and pay are better at the new job. it not personal just Biz...They might match the pay of your new job.

Whether you stay or go you are still entitled to workers compensation through Labor & Industry. You old boss wants you to stay at your current job on light duty probably because he thinks it will keep you from filing a claim, which costs the employer a lot of money in the short and long run. For every L&I incidet where workers comp is involved, the amount your employer pays every year to have that required coverage skyrockets. If you were actually injured, get the L&I right away. This will cover all the bills associated with it. Also, if you don't get the comp and later on down the line the injury turns out to be more serious, you would be SOL if you did not file a timely L&I claim.

I don' think that that's how it works. If you were hurt at the job and that's what caused your back injury, you were supposed to go to the doctor right then and there and have your employer file an accident report. This will serve as evidence later. Then you can file for Worker's Compensation.

If you had a paper stating you had to have light duty work and he didn't offer it until after you got another job, You might can still get Workman's comp. If you get set hours and higher pay, I would stick with it. I'm not sure about the workman's comp. if you have quit the job. But I'm sure if your old boss finds out you have a new job, He will not be wiling to give you workman's comp. Most bosses wouldn't anyway.
