I have been told they can go back 7 years and then also that the laws changed and now they can only go back for 3 years. Also if an individual files bankruptcy can back taxes be incorporated?

Bankruptcy cannot be used for Taxes......Tax is exempt from Court Discharge as are Student Loans...The IRS can go back 3 years basic: However, if "Fraud and or deceit" are grounds..They can go back as far as they desire especially if a "FALSE BANKRUPTCY" IS PART AND PARTIAL, which would be lying to a Court and submitting false documents.Blessings..........Annlee

No, banruptcy will generally not relieve you of the obligation to pay taxes, interest and penalties. As for not filing, and the IRS?s ability to prosecute tax non-filers, they can...   This information is from a phone conversation on 28 Sep 2009, 17:38 with an IRS agent...   If you have filed, and given fraudulent information, or you haven?t ever filed... You need a good tax lawyer and accountant Who will be able to negotiate on your behalf. NEVER try to take them on yourself.  Make sure your financial records are as accurate they can be, in terms of receipts and so on, and have a tax record prepared, basically a spreadsheet with all of the receipts listed in the correct categories, and the   This is something every one should do so that if they ever get audited, once you hand this to your lawyer to show them, they will usually think you are on top of things and not waste their time poking and prodding. It is the people who look like they have something to hide that they really go after.   Back taxes would most likely not be included, and in any event, bankruptcy is not a parachute.   In other words, you still have to pay something determined by the court and disbursed to a trustee every month for the duration of the amount you are obliged to settle for. Any debts owed at least 3 months prior to the bankruptcy would also have to be settled in full, so this is a long and difficult path with no fast fix.   A person in this situation did not get into trouble overnight, so they would certainly not be able to bounce out of it quickly.   I learned how to be better at business records and taxes from http://www.drewmiles.com/. The 7 year rule is for non-criminal actions.  If you accidently transposed numbers on a return 10 years ago, the IRS will probably let that go. But if you plain refused to file a return, that is a criminal offense, and they can come after you for everything you owe for those years, no matter how long ago it was, plus penalties and interest. You need a good attorney that can negotiate some of the interest and penalties down.  I don't think declaring bankruptcy will help either.  They will just wait for you to get back on your feet and garnish your new wages.
