If someone takes you to court for cell phone harassment and it is completely false?

Postby andor25 » Wed Oct 26, 2011 2:22 am

My sister just found out that her neighbor has filed harassment charges on her for texting her and asking her to turn down their tv. The accusations are false and we are not worried about the outcome of the case but are wondering if my sister can counter sue for defamation of character and her lawyer fees? They are military so my brother-in-laws command will know about this even though she has not harassed the woman and that's where the defamation of character comes in. Any advice will help. Her lawyer can't see her until tomorrow morning and I thought I would try to give her some piece of mind.

Contact your cell phone company and ask for paper copies of all the text messages sent to and from your sister's phone. That should help with the harassment charge.

Yes, a person can take another person to court for phone harassment and they would have to prove their side of the case to win
