My daughter in law moved out of the state with my sons 2 girls. She has been living with another man who i'm almost positive uses drugs. Is this considered child endangerment? Neither had sole custody even though she did sue him for child support. This is in the state of Va.

You need to be careful here. You need to be 100% positive if he is using in a case like this. If he is doing drugs in the home while the children are around, you can take legal action.

I would consider it child endangerment if drugs are used around the children or when this person is supposed to be responsible for the kids. Unfortunately you would most likely need proof that they are using. How old are the kids? Can they explain any 'strange' behavior? What is your son's opinion?

I'd also be curious about how this woman can move out of state when she doesn't have sole custody. Does she send them back to your son when it's his time to have them?

If you have not seen this happening then you really don't know what is going on. But you should, if you suspect this, call the authorities and have them check things out. If you are doing it out of spite because you don't like her having the children, then you need to leave them alone. Let your son deal with the custody issues and any problems involved.

If you have not seen this happening then you really don't know what is going on. But you should, if you suspect this, call the authorities and have them check things out. If you are doing it out of spite because you don't like her having the children, then you need to leave them alone. Let your son deal with the custody issues and any problems involved.
I'm pretty sure it's only considered child endangerment if she is using infront of the children, or is under the influence while responsible for the children. I would do some serious investigating and have proof before you make any accusations.

She isn't allowed to have her children around drugs. But unless you know for sure, then you need to keep your nose out of it. Sounds like you are just resentful of her having the kids, while your son does not.

That is tough since you don't for sure know they are doing drugs. But even if there wasn't a child around drugs are illegal so you could probably still get the child out of the situation some way or another.
