If your an independent contractor, in case of a law suit do you get sued or does your company get sued if ...?

a customer is unhappy or thinks the service I'm offering is a scam? Lets say for argument sake the company I work for is a scam but legally it can operate through the holes in our law. And the contract says that signing this contract doesn't mean your an employee of x company.
