We employed a broad who's employing subs.  The GC shattered the task into stages - hardwood, screen cut, units, etc.  He needed 50% remains (I understand - we were foolish...) on each stage as every began.  We settled 50% on two diverse phases.  One stage he claims has become 75% total, thus he wishes a development cost of 25% more for that subs on that phase.  Nevertheless,  we settled a lot more than what that quantity is on the diverse stage which he's completed very little function on.  Consequently, we've overpaid about the whole work which includes Both phases.  He also informed us he's no body planned to accomplish the job on our home and he's didn't meet deadlines and he stuffed his issues up, but is challenging money.  He'll not acknowledge nevertheless he is strolling down, however it is obvious as are his claims he doesn't have one planned to continue.  Are we required to cover the main one stage that's 75% completed despite the fact that he's overpayments about the additional stage and appears to be departing?

The deal does not need to be signed as such --a written payment schedule probably evidences a payment agreement....

Nothing was authorized but there is an estimation for function declaring 50% in advance for every stage, then 25PERCENT more at 75% total, the 25% at the conclusion.  We've usually compensated, however now it would appear that he's strolling down and it has the 50% on the diverse phase with out completed almost no focus on that stage.  Times were established in a routine plus they haven't been fulfilled for almost any stage of function.  Now he's mentioned he doesn't have one arranged to focus on the home more.  If he quit today, he'd be forward general.  And So I believe he must spend his subs who did focus on the 75% done phase-out of the overpayment we created about the additional stage that very little work was completed. Normally, if we spend much more today on the stage he wishes cash on, he'll be much more forward to walk-off.  Are we right for the reason that he's overpayment (enought to be regarded overpaid if he employed cash in the overpaid stage to pay for that one he wishes more income on) not to pay him more despite the fact that the stages will vary function products?  Thanks for that response, I relish it.

Have you got some kind of authorized deal wth the agreement?  in that case, that which was the contract for funds?  <br />
Should you had an arrangement using the company, I ought to believe you stay with that.  that which was the contract, if something, must deadlines not be fulfilled?  have you got any kind of contract about the schedule for this to become completed.<br />
As far as I understand, this really is likely to fall as to the was your contract.  to date, perhaps you have both been pursuing that which was decided?<br />
