Having a tough time financially. I know after the 3 day they serve a 5-day telling us of the eviction process, but I'm wondering since we havn't heard anything right after the 3 day if that means they ar'nt following through.

Congratulations! Now you get to go to court and have an eviction granted against you, then escorted of the property by a sheriff (usually within just a few days; FL is VERY landlord-friendly), then sued AGAIN for backrent owed, court fees, and the repairs and cleaning that will almost certainly be needed after you are thrown out.

I don't know where you got the idea that you get another notice; next is the summons to appear in court. They are following through, and the cost will probably be included in the lawsuit against you. Good luck ever renting again.

Fl. Law only requires the landlord to issue a 3 day. No 5 day notice is NOT needed. Expect a summons with a court date any time now. After that, you will have about 72 hours to vacate. Florida is a very landlord friendly state and judges seem to rule very harshly on non paying tenants.

Only one way to find out. Wrap anything fragile in bubble wrap so it doesn't break when the sheriff tosses it out on the street.
