In terms of the law, where do these two actions stand, no payment, distribution of data, no contracts?

Postby chiram97 » Mon Mar 26, 2012 2:05 pm

A financial analyst requested a translation be done. No contracts of any kind were signed by either party. After delivery, the translator requested payment for 2 weeks. The analyst cut off all contact with the translator. The translator's response to this was to post the original and the translated report on various sites on the internet and email it directly to various parties. Can the translator file a claim against the analyst? Can the analyst file a claim against the translator?

The translator has a claim against the analyst. The analyst initiated an implied contract by requesting the work be done, and a reasonable person would know that the translator doesn't work for free.

The translator did not breach any contract in posting and emailing the report, as there were apparently no terms to the original contract beyond the implied request for services in exchange for payment.

The analyst is a jerk, and the translator is an immature child.
