In the process of evicting: What I can / cannot do.?

Postby colten » Thu Oct 27, 2011 4:01 pm

Hello,
Just had a question I was hopping someone could help solve in regards to evicting tenants. We were renting our basement to a young couple about 3 months ago, and have made above normal accommodations for these tenants (i.e. free internet via wireless, one side parking, etc). We even put a door up for privacy only after about a 2-3 weeks of them moving in (which was an additional accommodation, but not a part of the agreement). Long story short, we were only charging $700 a month (which also includes utilities, and cable) and the 2 of them were struggling to pay it off. Finally got fed up and decided to give them an eviction notice since they were overdue on there monthly payments and could not maintain the agreement they signed for. We gave them 30 days to move, which was probably too long in my opinion, and during that time we started removing some of the additional items we were giving them (i.e. free internet). The door that we had put on as an added feature was taken down as well today, however I was a bit worried that this would violate privacy laws and what not. Then again, they have not paid the remaining balance on there rent and they don't plan to. I figured, whatever was not on the original agreement that they signed for should be taken away, but wanted to make sure that we weren't breaking any rules as landlords. I have never had this problem before in the last 10 + years until now so I'm also kind of new at this eviction process. Its not an easy thing to do, but it has to be done. If anyone has some incite on this, please feel free to respond. It would be very much appreciated :).

Thanks,
Frederica

You can't take away anything that is a part of the agreement.

until the eviction day they are still entitled to free wireless and anything else in their agreement .

I think they would have a strong case against you for removing these things while they still have tenancy .

I would also put the door back up as I'm sure they could use that against you as well.
