There are two VERY wrong answers. To assume that civil litigation does not come up on background checks is inaccurate. Depending on the depth of the background check, they DO check public court records. If you are listed as a party, you WILL show up in the court records. It is best to disclose the cause number and style (ABC Co. vs. DEF Co.) of the lawsuit and a brief description if it asks or gives you the opportunity to explain. Giving this information ahead of time shows honesty. If your name is on ANY pleading or document that is a matter of public record, criminal or civil, a very in depth background check WILL yield results.
