Is a schedule of special damages the final amount i will recieve for a personal injury claim?

Postby osryd » Sat Apr 02, 2011 8:39 pm

I've been asked to sign a schedule of damages by my solicitor for an injury that occured at work which meant I was signed off work for a few months. Is this the final amount I can expect or just the money I have lost through being signed off work and travel etc? They have already admitted liability and had medical report done.I have no idea about u.k law and the office is close for x-mas.
thanx

There are always two elements to personal injuries claims: general damages (which the court has to settle, unless they are agreed beforehand between the parties) to cover pain and suffering and the damage caused by the injury, and special damages, which are the things it is possible to quantify, i.e. the expenses which were incurred by the person as the result of the injury. If you have submitted all those to your solicitor, you can expect that if your employer admits liability they will be reimbursed, but that is only part of the picture.
