Is A Written Paper/agreement Amongst Family Legal For The Sale Of A House?

Postby Chilton » Sat Feb 08, 2014 5:30 pm

my family and I signed a paper in agreement for me to buy my grandfathers house after his passing. The house is deeded to the children for the last 9 years, not my Grandfather. It was not drawn up by an attorney, just the family but everyone agreed to the terms and signed it. Now that my Grandfather has passed 2 of them belive they can get more money for it and want to back out. My Grandfathers last wish was for me to have his house and I want to honor that. How legal is this written contract? It was not drawn up by an attorney and not notarized.

It is probably a a very binding legal document.   Without knowing the specifics of your local laws, I can't give you a definite answer.  You would need a local attorney for that.   If everyone voluntarily signed the document(no pressure), there are no hidden clauses(or side agreements), no one was omitted,  or unusual meanings of terms; I doubt any court would find any problems & things should stand as intended & written.   However, anyone can challenge any document in court & they may even win.  The judge can also decide the suit lacks any merit & toss it out of court when it is filed.   Those that wish to back out of the agreement should be very careful, they could backout so far that they are left with nothing.   Good luck.   Law of Human Nature:  You really don't know your siblings or other relatives until it comes time to share an inheritance.

It may or may not be enforceable depending on the law in your state and how badly the agreement was botched. There are fairly strict rules for this sort of thing and the way it was done is purely amateur hour. That was NOT the right way to accomplish what you were trying to do. You need an experienced real estate lawyer to review the situation and advise you of your options.
