someone took some cash from me and its about $1000 dollars, we had a deal that im supposed im gonna buy his car and i just put this to hold it. Later he didn't want to sell the car but also didn't give me the cash back..
now my question is:
is trying with small claims court worth it? i don't really have any evidence that i gave him the money. except maybe the voice mails he left me saying hes gonna pay it back
what are the chances of me winning this?

Yes, going to Small Claims is a good idea.

Write everything down in a "journal". Write your entries in chronological order. Keep your entries factual - DON'T say things like: "that guy is such a @##$%%". Judges like journals. Judges do NOT like voice mails, UNLESS you write them down (like in YOUR JOURNAL).

You will probably win.

The problem is going to be - even though you will probably win - finding a way to actually COLLECT.

Talk to the Clerk at the Small Claims Court - they can't give legal advice, but they will give you procedural advice.

It's not easy if you don't have proof like have they sign the receipt ... go to small claim court will take a lot of time and if you lose you have to pay some sort of fee. The best way is to have them reimburse some amount may be 50/50 it's the best solution.
