Is it illegal to sell an unoriginal idea?

Ok so if I seen an idea that would be cool to make and sell to friends but isn't mine but hasn't been trademarked or copyrighted yet is it still legal to make and sell?

Not illegal but it might be immoral to sell something to someone who doesn't realize they can get it for free.

get it copyrighted your self and then no one can say a thing because once you get something copyrighted no matter how long after another person made it you would still own the idea because the law is that the only thing that matters is who gets it copyrighted first. so if you get it copyrighted first and then you can actually sue who ever is making them now.

If it is illegal to sell an unoriginal idea, then 80% of all TV producers and writers would be in jail.
