Is It Legal For A Store That Cash Checks To Sue You If You Cash A Payroll Check There And It Comes Back Nsf?

i have been served with a legal citation from the lawyer hired by this store trying to make me liable for paying the amount the check was for but i don't see how that would be legal because i'm not the account holder.

You gave them a worthless piece of paper and they gave you valuable pieces of paper. You're stuck on the fact that your employer didn't have funds in his account to pay his employees, but that is between you and your employer . . . and your state's labor relations bureau. The store that did you the favor of cashing the check isn't about to get involved in that fight and is merely saying that if you bring a check in to be cashed, it'd better be a good check. Since they're not a bank, they get their money with lawyers, but they're still making you responsible like any bank would.

Yes, it is legal. It was a check written to you that you gave to them, you are obligated to have the check clear just like your company was obligated to you to have the check clear. You established a contract with the check place when you cashed the check there and are obligated to pay them back plus fees. In turn, your company that bounced a check to you owes you the check value plus the documented fee for it bouncing. The account holder doesn't owe them they owe you and you owe the check cashing company. The account holder has a contract with you. You are the one who involved the third party. Your name is on the check so the check cashing company can't go after the check writer only you.
